Terms of Service

1. Services

We provide custom website development, digital presence setup, lead generation tools and related digital services as agreed in each individual quote or project agreement.

2. Consumer Guarantees (Act 1993)

If you are acquiring our services as a consumer (for personal, domestic or household use), the services come with mandatory guarantees under the Consumer Guarantees Act:

• Carried out with reasonable care and skill
• Fit for any purpose made known to us
• Completed within a reasonable time
• Reasonably priced (if no fixed price agreed)

These guarantees cannot be excluded. Remedies apply in case of failure.

3. Pricing & Payment

Prices are quoted in NZD and exclude GST unless stated otherwise.

Typical payment terms: 40% deposit, balance on completion or in agreed milestones.

Late payments may incur interest at 1.5% per month.

4. Intellectual Property

We retain copyright in source code, templates and design elements until full payment is received. Upon full payment, you are granted a perpetual, non-exclusive licence to use the final delivered website/product for your business.

You warrant that any content you supply does not infringe third-party intellectual property rights.

5. Limitation of Liability

To the maximum extent permitted by law (and subject to mandatory consumer guarantees):

We are not liable for indirect, consequential or special losses (including lost profits, business interruption)

Our total liability is limited to the amount you paid for the specific services

6. Termination & Cancellation

You may cancel before significant work commences (deposit may be non-refundable for work already started).

We may terminate the agreement for non-payment, material breach or safety/legal reasons.

7. Governing Law

These terms are governed by the laws of New Zealand. Any disputes will be subject to the non-exclusive jurisdiction of the courts in Hamilton, New Zealand.
